GDPR

GDPR is Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, repealing Directive 95/46/EC. GDPR regulates matters related to the processing of personal data and has applied since 25 May 2018.

Purposes and legal bases for the processing of personal data

The personal data provided are processed for the purpose of providing services by the Controller, i.e., organising and enabling the use of logistics services provided by BOX Logistics Sp. z o.o. with its registered office in Robakowo (legal basis: Article 6(1)(b) GDPR).

The personal data provided are also processed:

  • for the purpose of fulfilling legal obligations imposed on the Controller, related to issuing invoices and maintaining financial reporting (legal basis: Article 6(1)(c) GDPR)

  • arising from the pursuit of the Controller’s legitimate interests (legal basis: Article 6(1)(f) GDPR), in particular:

    • for the marketing of services offered by the Controller,

    • for responding to enquiries submitted via the contact form,

    • for handling complaints related to the services provided by the Controller,

    • for purposes related to monitoring and improving the quality of the services provided by the Controller,

    • where applicable – for purposes related to conducting dispute proceedings and proceedings before public authorities and other proceedings, including for asserting and defending against claims,

    • for sending commercial information electronically within the meaning of the Act of 18 July 2002 on the provision of electronic services (where appropriate consent has been given).

Obligation to provide personal data

Providing the required personal data by a person using the Controller’s services (in the scope of enabling the performance of services by BOX Logistics Sp. z o.o. with its registered office in Robakowo) is a condition for correctly performing the agreement or handling an enquiry, complaint, or submission. Failure to provide the required personal data may prevent the Controller from providing services. Where personal data are collected based on consent, providing such data is voluntary.

Use of personal data

Personal data are collected only when provided to the Controller, e.g., by filling out a form or sending an e-mail, as part of the services provided, enquiries, or material requests.

The database and its contents remain with the Controller and are not shared in any form by the Controller or its subcontractors with third parties unless we obtain your consent or an official order is presented to us. We maintain control and responsibility for the use of the data you disclose to us. Your data may be processed on other servers and in other countries, e.g., in the USA.

Periods of personal data processing

The personal data provided will be processed for the period necessary to achieve the processing purposes, i.e., for the duration of:

  • the provision of services,

  • the fulfilment of legal obligations imposed on the Controller, including obligations related to data storage, e.g., for financial reporting purposes,

  • the pursuit of the Controller’s legitimate interests, in particular for the statutory limitation periods for claims,

  • until the consent is withdrawn – where processing is based on consent provided by the individual.

As a rule, the Controller stores personal data as long as necessary for the performance of the agreement or the provision of the ordered service, unless other obligations arise from laws, e.g., in the case of pending court proceedings.

This period may be extended due to granted marketing consents or other needs resulting from updates to previously concluded agreements.

Rights of the data subject

In connection with the processing of personal data, the data subject has the following rights:

  • the right of access to personal data, including the right to obtain a copy,

  • the right to request rectification (correction) of data,

  • the right to request the deletion of personal data (the so-called “right to be forgotten”),

  • the right to request the restriction of data processing,

  • the right to data portability, including the right to transfer data directly to another controller,

  • the right to object to the processing of personal data.

Right of access and correction of collected data

You have the right to check and correct any data collected by BOX Logistics Sp. z o.o. if you believe they are outdated or incorrect. To do so, simply send an e-mail to the person responsible for personal data protection.

Right to withdraw consent to data usage

You may withdraw consent to the use of your personal data at any time with future effect. To do so, simply send an e-mail to the designated personal data controller.

Profiling and automated decision-making

For some services, we may process personal data automatically. This means that decisions are made automatically without human intervention. For example, the system, having personal data such as name, surname, home address, e-mail address, phone number – automatically personalises communication sent to the user according to their preferences and interests.

We may also process your personal data for profiling purposes to predict your behaviour on our website and determine which services may be of interest to you.

If we intend to apply such methods, we will inform you and give you the opportunity to object in advance.

Security requirements

The Personal Data Controller uses technical and organisational measures to protect personal data obtained from accidental or intentional loss, destruction, or access by unauthorised persons. When collecting and processing personal data, the information is transmitted in encrypted form to prevent misuse by third parties.

Possible collection of statistical data

Using the website generally does not require disclosing personal data. However, for security reasons, the following data will be stored when using the service: the name of the user’s Internet service provider, the website from which you visited our service, the pages of our site that you visited, and the IP address of your computer.

Although such data may allow identification, they are not used concerning any specific person. These data may be used for statistical purposes, with individual users remaining anonymous. If the data must be provided to external entities performing technical services, the technical and organisational measures we use ensure compliance with personal data protection regulations.

Children

Without the prior confirmed consent of a legal guardian, the Personal Data Controller does not collect, process, or use any information on this website about persons known to be under 13 years of age.

Transfer of personal data to entities outside the European Economic Area (EEA) or international organisations

The Controller does not plan to transfer your personal data to entities outside the EEA or to international organisations.
